Conditions of Hire
1. The Hirer will not sub-let the Hired Premises.
2. Bookings will be secured by signing the Agreement.
3. The Hirer will be liable to pay for the booking if it is cancelled less than 48 hours in advance.
4. Invoices should be paid within 28 days. Further bookings will be provisional if invoices are outstanding.
5. The Hirer will be responsible for the conduct of all persons using the premises under the Agreement.
6. The Hirer will be responsible for any damage to, or loss of, furniture, fittings or equipment that is the property of The Harlow Children’s Centre Network (HCCN) that is used during the course of the hire period.
7. HCCN reserves the right to terminate an activity or event, or future events in a series, if it is not conducted in an appropriate manner.
8. The Hired Premises must be used for the purpose stated on the Agreement.
9. HCCN reserves the right to cancel a booking at short notice in the event of an over-riding emergency consistent with the operation of the Core Offer for Children’s Centres. In this circumstance the booking fee would be refundable but compensation would not be paid.
10. HCCN reserves the right to cancel a booking in the event of force majeure (e.g. national or local emergency, war, prohibitive Government regulation or other cause beyond the reasonable control of HCCN.)
11. The Hirer shall, during the period of hire, be responsible for good order and decency within the Hired Premises.
12. The Hirer shall, during the period of hire, ensure that noise levels are reasonable.
13. The Hirer shall, during the period of hire, ensure that their activities do not adversely impact on other services or activities taking place in the building at the same time.
14. The Hirer will not interfere with or make alterations to lighting, heating, fixtures and fittings, apparatus or furniture.
15. The Hirer will maintain their own indemnity and public liability insurance in respect of activities they run within the Hired Premises.
16. HCCN accepts no responsibility for loss or damage to goods or property of the Hirer that occurs on Children’s Centre premises. All such items are brought to the premises at the Hirer’s own risk.
17. The Hirer will take responsibility for acquainting themselves with the Centre’s emergency procedures and fire exits and will be responsible for adequately briefing their service users or guests.
18. Regarding out of hours use, the Hirer will be responsible for the security of the building (ensuring windows are closed etc.). The Hirer will make their own arrangements for managing reception as the front door cannot be left open unattended while people arrive.
19. If the Hirer is a key holder they will be responsible, when using the premises out of hours, for leaving the building secure, setting the alarm and locking the front door. 20. HCCN will not compensate the Hirer in the event of failure of the heating system or utilities.
21. The Hirer will be responsible for setting rooms out and putting furniture back as it was.
22. The Hirer will leave the room/s in a clean and orderly condition.
23. The Hirer will not use pins, tacks, ‘Blutack’ or similar on walls, woodwork dados etc.
24. The Hirer will not bring balloons filled with flammable gas onto Children’s Centre premises.
25. Hirers may display publicity materials within Children’s Centre premises at the discretion of the centre’s Operations Manager.
26. The Hirer will comply with the Copyright, Designs and Patents Act 1988, for example in relation to materials used for display or training purposes, and will indemnify HCCN and its Lead Body (Harlow District Council) from and against all actions, proceedings, costs, claims or demands arising out of a failure to do so.
27. The Hirer will comply with the conditions of HCCN’s Performing Rights Licences (copy available on request).
28. The Hirer will comply with HCCN’s Hot Drinks Policy (copy available on request).
29. In buildings with a cafe, refreshments can be arranged for the Hirer. In buildings without a cafe, please speak to the Operations Manager to make suitable arrangements.
